Dr. Rajan Lekhraj Mahtani Remain Lawful Owner Of The Portland Cement

Dr. Rajan Lekhraj Mahtani’s name is synonymous with virtue, patience, transparency and honesty. He is one of those few businessmen in Zambia having faith in the Zambian government and law, despite facing several challenges due to the widespread corruption and incapability of the Zambian law to provide for quick and ethical judgement. This even holds true for Dr. Rajan Lekhraj Mahtani who faced significant challenges in the case of Portland Cement Zambia. Despite gaining majority shareholding and legal ownership for the Portland Cement Zambia factory, it was unethically and illegally taken over. This started a significant battle for the factory ownership that lasted for more than a decade. First it was Lusaka High Court wherein the case dragged for more than a decade. Despite this long tenure court failed to provide justice for Dr. Rajan Mahtani. However, Dr. Rajan Mahtani did not lose faith in the Zambian justice system and once again approached the Higher Court of Appeal. Justice Mwinde on behalf of the higher Court of Appeal announced his decision on 31st January 2019. In his decision, justice Mwinde reversed the decision from the Lusaka High Court and announced that Dr. Rajan Mahtani is actually the majority shareholder and legal owner of the Portland Cement Zambia factory according to the evidences and legal papers.

It seems like the Ventriglia family did not accept this authentic and transparent judgement from the higher Court of Appeal and decided to approach the Supreme Court Zambia. A bench was established with three SC judges and upon evaluation, it was found that the Ventriglia family failed to comply with critical legal requirement in which all claims against previous court decision must be submitted within 14 days of the court decision itself. However, the Ventriglias submitted their case after more than 1.5 years, automatically turning their claim invalid. Other evidences were missing and the claim was found to be questionable. Based on this, the Supreme Court effectively rejected the claim by the Ventriglia family.
