Dr. Rajan Mahtani Redirects The Case Of Portland Cement At Court Of Appeal, Wins Case

Being one of the most straight-forward and ethical businessmen in Zambia, Dr. Rajan Mahtani has never been the one to give-up. Despite these challenges faced at the Lusaka High Court, Dr. Mahtani was sure that the final decision will come in his favour only considering all evidences and testimonials. However, the final decision coming from the Lusaka High Court judge was extremely controversial as the Ventriglias family was announced as only shareholder of the Portland Cement factory despite lack of evidences and facts from their side. As a result of this controversial decision, Dr. Rajan Lekhraj Mahtani’s next step was approaching the higher Court of Appeal, among the highest legal courts in Zambia. The judge at the higher Court of Appeal, justice Mwinde, announced that the decision will be quick and it was, given within a timespan of nine months. While nine months can be considered as too long for many, especially those nations with effective and fast-track courts, this timeline is comparatively quicker considering the initial long-running of the case as well as the various challenges and issues faced by businesses due to the lack of ethical and legal standings of even the courts. As such, the final verdict by justice Mwinde on behalf of the Court of Appeal came on 31st January 2019. After considering the evidences, facts, reports, testimonials and other details, justice Mwinde declared Dr. Rajan Mahtani as the actual owner and majority shareholder of the factory. This decision was given based on the fact that Dr. Rajan Lekhraj Mahtani, in the year 2005, made a payment of one billion kwachas or USD 250,000 to the Portland Cement Zambia limited which covered the value of the entire share capital which Dr. Rajan Mahtani took over.

Based on these critical evidences, Dr. Rajan Lekhraj Mahtani was announced as actual owner and majority shareholder of the Portland Cement Zambia factory.
