After Ten Long Years Of Wait, Justice Was Finally Given To Dr. Rajan Mahtani With Huge Case Win

For the past ten years, Dr. Rajan Mahtani has been fighting for the legal takeover of the Zambezi Portland Cement. The cement manufacturing plant is yet another successful business venture from Dr. Mahtani. However, the factory was illegally taken over by the Ventriglias and this forced Dr. Mahtani to register a case at the Lusaka High Court. While Dr. Rajan Mahtani endured all limitations and shortcomings of an effective court system in Zambia, he was not given rightful justice even then. The judge from the Lusaka High Court announced that Ventriglias were only shareholders of the Zambezi Portland Cement factory. This again forced Dr. Rajan Mahtani to register another appeal, this time to the higher Court of Appeal at Zambia.

Being one of the top legal and judiciary system of a nation, the Court of Appeal did not disappoint. After around nine months of registering the appeal from Dr. Rajan Mahtani, the Court of Appeal announced its final decision on the Zambezi Portland Cement case. On 31st January 2019, the decision was given that Finsbury Investments holds 58 percent shares and thereby, it is the majority shareholder of the Zambezi Portland Cement factory. On the other hand, Ventriglias owned Ital Terrazzo Limited holds 42 percent shares at the factory and is the minority shareholder. This shareholding pattern aligns with the originally established agreement in the year 2007. Furthermore, the judge at the Court of Appeal while giving the judgement also said that the judge below him was wrong in declaring Ventriglias as only shareholders without having any evidence to prove the same. Justice Mwinde from Court of Appeal said that this type of justice was against the interest of the public policies and must be avoided at all costs.

As of now, a timeline of three months from judgement date at the Court of Appeal has been given by the judge. During this time, all share regularization process should be completed.
