Dr. Rajan Mahtani Finally Announced Winner Of Portland Cement Zambia After a Decade Long Case Fight

After a wait of more than a decade and struggle across several courts, Dr. Rajan Mahtani has now been given final justice. This justice was given by judge Mwinde from the Court of Appeal and relates to Portland Cement Zambia, a noted cement manufacturing factory in Zambia. The case dates back to more than a decade ago when it was first registered at the Lusaka High Court. The judge at the Lusaka High Court who gave the decision was justice Nkonde. He provided an extremely controversial judgement by announcing Ventriglias as only shareholders of the Zambezi Portland Cement.

This judgement was further countered by Dr. Rajan Mahtani at the Court of Appeal. The judge at the Court of Appeal was justice Mwinde who looked into all evidences and testimonials and provided the final judgement in comparatively quick session. The final decision on the Portland Cement Zambia case at the Court of Appeal was announced on 31st January 2019. According to this decision, Dr. Rajan Mahtani is the actual owner of the Portland Cement Zambia factory with 58 percent shares. On the other hand, Ventriglias are just minority shareholders with 42 percent shares at the factory and do not have any legal ownership over the factory. This decision is in line with the original shareholders agreement established in the year 2007. Furthermore, the judge at the Court of Appeal also said that the judge below him was wrong in declaring Ventriglias as only shareholders of the Zambezi Portland as this decision was biased and without any evidence or proof.

Furthermore, the Court of Appeal also provided a timeline of three months from the date of the judgement during which all parties were required to proceed with regularization of the sales of shares process. The parties were required to complete this process as per the latest Shareholders Agreement established by the Court of Appeal.
